Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the OceanDeals platform (“Platform”), operated by Omnez GmbH, Brandheide 4A, 22397 Hamburg, Germany (“we”, “us”, “our”). By creating an account or using the Platform, you agree to these Terms.

1. Definitions

“Platform” refers to the OceanDeals website, application, and all related services. “User” refers to any registered individual or entity using the Platform, whether as a shipper or freight forwarder. “Services” refers to the marketplace, search, quotation, and booking functionalities provided through the Platform.

2. Eligibility and Registration

The Platform is intended for business use only (B2B). By registering, you confirm that you are authorized to represent the company on whose behalf you are registering. You agree to provide accurate and complete information, including a valid Tax Identification Number (VAT, VKN, or equivalent). All accounts are subject to verification before full access is granted.

3. Platform Services

OceanDeals provides a digital marketplace connecting shippers and freight forwarders for ocean freight services. We facilitate the discovery of rates, submission of quotation requests, and communication between parties. OceanDeals does not itself provide freight forwarding, shipping, or transportation services. We act as a marketplace intermediary.

4. Fees and Payments

Subscription fees, booking fees, and success fees are charged according to the pricing plan selected by the user. All fees are disclosed on our pricing pages and in the user dashboard. Fees are billed in accordance with the applicable plan terms. OceanDeals reserves the right to update pricing with reasonable advance notice.

5. User Obligations

Users must not misuse the Platform, provide false information, or engage in fraudulent activity. Forwarders are responsible for the accuracy of their published rates and the fulfillment of accepted bookings. Shippers are responsible for providing accurate cargo and shipment information.

6. Intellectual Property

All content, branding, and technology on the Platform are the property of Omnez GmbH or its licensors. Users may not copy, reproduce, or redistribute Platform content without prior written consent.

7. Limitation of Liability

OceanDeals is a marketplace and does not guarantee the performance, reliability, or accuracy of services provided by third-party forwarders or shippers. To the maximum extent permitted by law, Omnez GmbH shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform.

8. Data Protection

Your use of the Platform is also governed by our Privacy Policy. We are committed to protecting your data in accordance with the EU General Data Protection Regulation (GDPR).

9. Termination

Either party may terminate the account at any time. OceanDeals reserves the right to suspend or terminate accounts that violate these Terms or engage in activity harmful to the Platform or its users.

10. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hamburg, Germany.
